What the agreement covers

Classification is about facts, not paper

An agreement calling someone a contractor does not make them one. What matters is control over how the work is done, whether they have their own business and clients, and (in ABC-test states such as California, Massachusetts and New Jersey) whether the work is outside the client's usual business. Write the agreement to reflect a real contractor relationship and run it that way.
